The Nigerian Bar Association (NBA), through its Administration of Criminal Justice Committee led by Andem Ewa, SAN, has released its second “Nugget” series.
These guidelines outline the minimum standards expected at the trial stage to ensure efficiency, fairness, and speed in the temple of justice.
Here is what every legal practitioner, stakeholder, and citizen needs to know about the modern trial process under the ACJA/ACJL framework.
1. Disclosure: No More Trial by Ambush
To ensure fairness, the era of “surprise evidence” is over.

Frontloading: The Prosecution must disclose all evidence before the trial begins.

The 14-Day Rule: If a defendant chooses to enter a defense, they must disclose their witness statements, documents, and expert reports within 14 days after the prosecution closes its case.

Confessions: Any objection to a confessional statement must be raised pre-trial or within the court’s specific timeline. Failure to do so may result in a waiver of that objection.
2. Protecting the Defendant’s Rights
The integrity of a trial depends on the defendant’s ability to defend themselves.

Right to Counsel: Courts must inform unrepresented defendants of their right to a lawyer. If they cannot afford one, the court must facilitate a referral to the Legal Aid Council, Office of the Public Defender, or the NBA within 30 days.

Virtual Hearings: In line with global best practices, representation and proceedings may now be conducted via audio-visual links.
3. Curbing Delays: Judges, Absconders, and Stays
The standards address the common “bottlenecks” that drag cases on for decades.

Trial in Absentia: If a defendant absconds after arraignment, the court will no longer wait indefinitely. The trial, judgment, and sentencing can proceed in their absence.

No More “Starting Afresh”: If a Judge or Magistrate is transferred, the successor continues the trial from where it stopped, provided it has reached an advanced stage (e.g., the prosecution has closed or at least three witnesses have testified).

The End of “Stay of Proceedings”: Interlocutory appeals no longer stop the clock. Rulings on such matters are delivered alongside the final judgment to ensure the trial flows without interruption.
4. Modern Justice Tools: Plea Bargaining and Case Tracking
Justice is not just about punishment; it’s about resolution and data-driven management.

Institutionalized Plea Bargaining: States are mandated to create clear guidelines for plea bargaining that protect the public interest and the rights of victims while offering a transparent exit for appropriate offenders.

Digital Case Tracking: The Attorney-General of the Federation (AGF) and State AGs are tasked with deploying integrated systems. This links courts, law enforcement, and prosecutors in real-time to monitor delays and ensure no case falls through the cracks.
